Terms of Service

1. Acceptance
By accessing or using any product or service offered by General Action, Inc. (“Company,” “we,” “us”), including (a) the Cloud Edition, (b) the open-source Self-Hosted Community Edition, and (c) any paid Enterprise (“EE”) features (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. Changes
We may amend these Terms at any time. Material changes take effect 30 days after posting. Continued use constitutes acceptance.
3. License and Scope of Use
Self-Hosted Community Edition (AGPL v3).
The Community Edition source code is licensed under the GNU Affero General Public License v3.0 (“AGPL v3”) as reproduced in the repository. You may run, copy, modify, and redistribute that code under AGPL v3. If any provision of these Terms conflicts with AGPL v3, the AGPL v3 controls for the Community Edition.
Enterprise (“EE”) Features.
Code located in /ee
folders or otherwise designated as “Enterprise” is licensed only under a separate commercial Enterprise License Agreement (“ELA”). Unless and until you purchase an EE subscription and accept the ELA, you have no license to EE code.
Cloud Edition (hosted by us).
Upon payment of applicable fees, we grant you a non-exclusive, revocable, worldwide right to access and use the Cloud Edition for your internal business or personal purposes, subject to these Terms and any order form.
Nothing in these Terms limits your rights under AGPL v3 for the Community Edition.
4. Fees and Payment
Cloud Edition and EE subscriptions are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. Failure to pay may suspend or terminate access.
5. Prohibited Conduct
You must not (a) interfere with security or performance; (b) reverse-engineer the Cloud Edition or EE code; (c) use the Service to violate law or the rights of others; or (d) falsely imply endorsement, partnership, or affiliation with us.
6. Intellectual Property
The Service name, logos, hosted platform code, EE code, and all content we publish are owned by us or our licensors and protected by intellectual-property laws. Except for the licenses expressly granted in Section 3, all rights are reserved.
7. Disclaimer
The Service is provided on an “as is” and “as available” basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. For the Self-Hosted Community Edition we provide no support or updates except at our sole discretion.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed (i) USD 100 or (ii) the fees you paid us for the Cloud Edition and/or EE features during the 12 months preceding the event giving rise to liability, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages.
9. Governing Law and Venue
These Terms are governed by the laws of the State of California, excluding conflict-of-laws rules. Exclusive jurisdiction and venue lie in the state or federal courts located in San Francisco County, California.
